If you are an Australian citizen, permanent resident or eligible New Zealand citizen who is in a de facto or marital relationship with a person who is not an Australian citizen or permanent resident, you may be able to sponsor then to live with you in Australia on a permanent basis as your spouse or de facto partner.
There are three types of partner visa:
- Onshore Partner Visa (subclass 820/801) – can only be applied if visa applicant is in Australia at time of application and grant.
- Offshore Partner Visa (subclass 309/100) – can only be applied if the visa applicant is outside Australia at time of application and grant.
- Prospective Marriage Visa (Subclass 300) – also referred to as ‘Fiancée Visa’
This visa is applied in 2-stages (i.e., temporary and permanent). The application for both stages is applied for in the initial application. The visa applicant must proof that the relationship is genuine and continuing. If successful, the visa applicant will be granted the temporary stage (subclass 801 or subclass 100). After 2 years the relationship is re-assessed and if still genuine and ongoing or if exceptional circumstances exist the applicant will be granted the permanent visa (subclass 820 or subclass 100)
